1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Nord Cazzit Pty Ltd (ABN: 12 345 678 901) ("Nord Cazzit," "we," "our," or "us") regarding your use of our vocal coaching services, website, and related services.
By accessing our website, enrolling in our courses, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
These Terms apply to all users of our services, including students, parents/guardians of minor students, and website visitors.
2. Description of Services
2.1 Vocal Coaching Services
Nord Cazzit provides professional vocal coaching services including:
- Individual vocal lessons with certified instructors
- Group vocal classes and workshops
- Intensive vocal training programs
- Performance coaching and preparation
- Vocal health and technique education
2.2 Service Delivery
Services are provided at our Melbourne studio location and may include:
- In-person instruction at our facilities
- Online lessons via video conferencing platforms
- Hybrid learning combining in-person and online elements
- Educational materials and resources
2.3 Service Modifications
We reserve the right to modify, suspend, or discontinue any part of our services at any time. We will provide reasonable notice of material changes that affect enrolled students.
3. Eligibility
3.1 Age Requirements
- Adults (18+): May enroll independently
- Minors (13-17): Require parental/guardian consent and supervision
- Children (under 13): Require parental/guardian enrollment and presence during lessons
3.2 Health Considerations
Students must disclose any health conditions that may affect their ability to participate safely in vocal training. We reserve the right to require medical clearance for participation.
3.3 Capacity to Contract
By using our services, you represent that you have the legal capacity to enter into these Terms and comply with all applicable laws.
4. Account Registration
4.1 Account Creation
To access certain services, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.
4.2 Account Security
- Choose a strong, unique password
- Do not share your login credentials
- Notify us immediately of any unauthorized access
- You are responsible for all activities under your account
4.3 Information Accuracy
You must provide accurate, current, and complete information during registration and update it promptly when changes occur. False information may result in account suspension or termination.
5. Fees and Payment
5.1 Course Fees
Current pricing for our services is available on our website and subject to change. All prices are in Australian Dollars (AUD) and include GST where applicable.
5.2 Payment Terms
- Individual Lessons: Payment due before or at the time of each lesson
- Course Packages: Full payment required upon enrollment unless payment plan arranged
- Workshops: Full payment required at time of registration
5.3 Payment Methods
We accept major credit cards, debit cards, bank transfers, and other payment methods as specified during checkout. Payment processing is handled by secure third-party providers.
5.4 Late Payment
Late payment may result in suspension of services. A late fee of $25 may be charged for payments overdue by more than 14 days.
5.5 Refunds
Refund eligibility depends on the type of service and timing of cancellation. See Section 6 for specific cancellation and refund policies.
6. Lesson Scheduling and Cancellation
6.1 Scheduling Policy
- Lessons are scheduled by mutual agreement between student and instructor
- Regular lesson times may be established for ongoing students
- Schedule changes require at least 24 hours notice when possible
6.2 Student Cancellation Policy
- 24+ hours notice: Full credit or refund available
- Less than 24 hours: 50% of lesson fee charged
- No-show: Full lesson fee charged
- Emergency situations: Considered on case-by-case basis
6.3 Instructor Cancellation
If we cancel a lesson, you will receive a full refund or credit. We will make reasonable efforts to reschedule or provide an alternative instructor.
6.4 Course Withdrawal
- Before course start: Full refund minus $50 administrative fee
- Within first week: 75% refund
- After first week: No refund, but course credit may be available
6.5 Medical/Emergency Withdrawal
Medical documentation may qualify students for special consideration regarding refunds or course credits.
7. Student Conduct
7.1 Expected Behavior
Students are expected to:
- Treat instructors, staff, and other students with respect
- Arrive punctually for scheduled lessons
- Come prepared and ready to learn
- Follow studio rules and safety guidelines
- Maintain appropriate volume levels during practice
7.2 Prohibited Conduct
The following behaviors are prohibited:
- Harassment, discrimination, or inappropriate behavior
- Disruptive or disrespectful conduct
- Damage to property or equipment
- Recording lessons without explicit permission
- Soliciting other students for private lessons or commercial purposes
7.3 Consequences
Violations may result in warnings, suspension, or termination of services without refund, depending on severity.
8. Intellectual Property
8.1 Our Content
All content provided by Nord Cazzit, including lesson materials, exercises, recordings, and methodologies, is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.
8.2 Student Recordings
We may create recordings of lessons for educational purposes with your consent. You retain rights to your performance, but grant us permission to use recordings for internal training and quality assurance.
8.3 Public Performances
Students may perform songs learned in our courses publicly, subject to applicable copyright laws and licensing requirements.
8.4 Website Content
Our website content, including text, graphics, logos, and software, is owned by Nord Cazzit and protected by intellectual property laws.
9. Limitation of Liability
9.1 Service Limitations
While we strive to provide high-quality instruction, we cannot guarantee specific outcomes or results. Individual progress depends on factors including natural ability, practice, and commitment.
9.2 Health and Safety
Vocal training carries inherent risks. Students participate at their own risk and should consult healthcare providers about any concerns. We are not liable for vocal strain or injury resulting from improper technique or overuse.
9.3 Property Damage
Students are responsible for any damage they cause to our property or equipment. We are not liable for personal items lost, stolen, or damaged on our premises.
9.4 Limitation of Damages
To the maximum extent permitted by law, our liability is limited to the amount you paid for services in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
9.5 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies rights under the Australian Consumer Law that cannot be excluded, restricted, or modified.
10. Termination
10.1 Termination by Student
You may terminate your enrollment at any time, subject to our cancellation policy in Section 6.
10.2 Termination by Nord Cazzit
We may terminate your enrollment for:
- Breach of these Terms
- Non-payment of fees
- Inappropriate conduct
- Safety concerns
10.3 Effect of Termination
Upon termination, your access to services ceases immediately. You remain liable for all fees incurred prior to termination.
11. Privacy
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Dispute Resolution
12.1 Initial Resolution
We encourage direct communication to resolve disputes. Please contact us first to discuss any concerns.
12.2 Mediation
If direct resolution fails, disputes may be referred to mediation through a mutually agreed mediator or the Australian Dispute Resolution Association.
12.3 Arbitration
Disputes not resolved through mediation may be submitted to binding arbitration under the Australian Arbitration Rules.
12.4 Class Action Waiver
You agree not to participate in class action lawsuits against Nord Cazzit related to these Terms or our services.
13. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any legal proceedings must be brought in the courts of Victoria, and you consent to the jurisdiction of those courts.
14. Changes to Terms
14.1 Modification Rights
We reserve the right to modify these Terms at any time. Material changes will be communicated through:
- Email notification to registered users
- Prominent notice on our website
- In-person notification for current students
14.2 Effective Date
Changes become effective 30 days after notification unless you terminate your enrollment. Continued use of our services constitutes acceptance of modified Terms.
14.3 Existing Enrollments
Material changes to fees or cancellation policies will not affect existing course enrollments unless mutually agreed.

Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and any additional agreements, constitute the entire agreement between you and Nord Cazzit regarding our services.
